Terms of Service

Welcome to Curb Crews. These Terms of Service ("Terms") are a binding agreement between you and Curb Crews, a service of Anchor Capital TX LLC ("Curb Crews," "we," "us," or "our"), that govern your use of our website and our residential trash-can valet service (the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Curb Crews provides a residential trash, recycling, and related cart valet service in and around Austin, Texas. On your scheduled collection days, a local crew moves your carts from their storage location to the curb before pickup and returns them after collection. The specific tasks depend on the plan and add-ons you select.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You must own the property you sign up, or have permission from the property owner to authorize us to access it and move the carts. The Service is available only in areas we currently serve, and service availability may change over time.

3. Your Account

You are responsible for the accuracy of the information you provide, including your address, collection day, cart locations, and any gate or access codes. You are responsible for keeping your account credentials secure and for activity that happens under your account. Please notify us promptly of any unauthorized use.

4. Property Access

To perform the Service, you grant us and our crews permission to enter your property and reach the area where your carts are stored, on collection days and as reasonably needed. You are responsible for providing accurate access instructions, including cart location, gate codes, garage codes, pets, and any hazards. We are not responsible for an inability to perform the Service when access information is inaccurate, incomplete, or out of date, or when access is otherwise obstructed.

5. Subscriptions, Billing, and Renewal

The Service is offered as a recurring monthly subscription. By subscribing, you authorize us and our payment processor to charge your payment method the recurring fee plus any add-ons and applicable taxes. Your subscription automatically renews each month until you cancel, pause, or hold it. We may change prices, and we will provide reasonable advance notice, with changes applying to your next billing cycle. All payments are processed by Stripe; we do not store your full card details.

6. Pauses, Holds, and Cancellation

You can manage your plan at any time from your account:

  • Pause for vacation: choose a return date. Billing stops for the paused period and resumes automatically on your return date.
  • Hold your membership: stop billing with no end date. Your service and billing resume only when you choose to resume.
  • Cancel: cancel anytime with no cancellation fee. Cancellation takes effect at the end of your current paid billing period, and you keep service through that period.

Except where required by law, fees already paid are non-refundable. Paused and held periods are not charged.

7. Add-Ons and One-Time Services

You may add optional services, such as a recycling cart, yard-waste cart, or cart cleaning, for additional recurring fees. One-time services such as bulk or junk pickup are quoted and billed separately and are subject to these Terms.

8. Service Schedule and Missed Pickups

We schedule service based on your municipal collection calendar, including recognized holiday shifts. Collection schedules are set by your municipality and may change; we are not responsible for changes made by your city or hauler. We aim for reliable, on-time service. If we miss a scheduled service for a reason within our control, we will credit that occurrence to your account. We are not responsible for missed municipal collection, weather events, road closures, or other circumstances beyond our reasonable control.

9. Your Responsibilities

You agree to place acceptable materials in your carts in line with your municipality's rules; to keep hazardous, prohibited, or overweight materials out of your carts; to keep the cart access area reasonably safe and accessible; and to keep your account and access information current. You remain responsible for your carts and their contents.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Curb Crews and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Curb Crews and its owners, employees, and contractors from any claims, damages, or expenses arising out of your breach of these Terms, your violation of any law, or your misuse of the Service.

13. Communications

By providing your email and phone number, you agree that we may contact you about your account and the Service, including service updates and reminders. You can opt out of non-essential messages, though we may still send transactional messages necessary to provide the Service. Message and data rates may apply.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

15. Termination

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay, or use the Service in a way that is unsafe, unlawful, or harmful. You may stop using the Service at any time by canceling your subscription.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
